PADUCAH, Ky. - A federal judge denied motions for summary judgment by two home insurers on Jan. 10, saying that the policies do not support the carrier's argument that coverage for an ensuing loss is limited to situations where the cause would not be an excluded loss. Eckstein v. Cincinnati Insurance Co., et al., No. 5:05CV-043-M (W.D. Ky.).
In two separate opinions, Judge Joseph H. McKinley Jr. of the U.S. District Court for the Western District of Kentucky ruled against Cincinnati Insurance Co. and Great Northern Insurance Co. on several issues, including ensuing loss and the timeliness of notice.
