5th Circuit Affirms Dismissal of 'Agent' State Farm Lloyd's Inc.

NEW ORLEANS - A federal circuit court has affirmed the dismissal of State Farm Lloyd's parent company, rejecting the insureds' contention that State Farm Lloyd's Inc. could be liable because it reserved the right to make final decisions on claims adjustments. Martinez v. State Farm Lloyds, et al., No. 06-40442 (5th Cir.).
The 5th Circuit Court of Appeals panel also affirmed summary judgment for State Farm Lloyd's on statute of limitations grounds, finding that while the complaint was timely plaintiffs failed to show due diligence in attempting to serve the insurer within two years.
