NEW YORK - A New York judge has denied owners of a penthouse condominium leave to add punitive damages to their property damage claims against the residential board and has scheduled the dispute for trial on Oct. 30. Brasseur v. Speranza, et al., No. 102949/04 (N.Y. Sup., N.Y. Cty.).
In her Sept. 29 order, New York Supreme Court Justice Carol R. Edmead denied the condominium owners' motions for injunctive relief and judgment on damage and diminution of value claims, but did order defendants to install noise abatement equipment to comply with New York City building codes.
