N.Y. Court Dismisses Injury Claims After Excluding Johanning Testimony

NEW YORK - A New York trial judge ruled Sept. 26 that positions taken by Dr. Eckhardt Johanning are not supported by scientific evidence and he could not testify for plaintiffs alleging injury from mold. Fraser v. 301-52 Townhouse Corp., et al., No. 113586/02 (N.Y. Sup.).

New York County Supreme Court Justice Shirley W. Kornreich issued her decision after a 10-day Frye hearing during which she reviewed dozens of scientific papers submitted by the parties and heard testimony from Dr. Johanning and three other experts (Frye v. United States, 293 F. 1013 [D.C. Cir. 1923]).
