TOLEDO, Ohio - An Ohio appellate court on July 14 affirmed summary judgment for an architectural firm sued for contribution and indemnification over more than $1 million in repairs necessitated by leaks and mold in a medical school building. Mosser Construction Inc. v. Western Waterproofing Co., No. L-05-1164 (Ohio Ct. App., 6th Dist.).
Munger Munger & Associates was retained by the State of Ohio in 1993 to design the Howard L. Collier Nursing & Allied Health Building at the Medical College of Ohio. The state contracted separately with Mosser Construction Inc. to act as general contractor on the building.
