N.Y. Court Dismisses Fraud Suit Against Seller of Conn. Home

NEW YORK - A New York trial court on Aug. 11 dismissed contract and fraud claims against the sellers of a single-family Connecticut home and other parties, finding that the buyers failed to show they relied on the allegedly deceptive disclosure in making the purchase. Hritz v. Saco, No. 60101/03 (N.Y. Sup. Ct., N.Y. Cty.).

The New York County Supreme Court also denied the buyers' motions for discovery sanctions against a real estate broker, saying they failed to show that emails were neligently or intentionally deleted to hide evidence.
