LOS ANGELES - A California appeals court has reinstated a couple's lawsuit against their condominium association after reversing an order enforcing an oral settlement agreement the association says it never approved. Elnekave v. Via Dolce Homeowners Association, No. B184526 (Calif. App. Ct., 2nd Dist.).
California's 2nd Appellate District ruled Sept. 12 that despite agreement by State Farm, which insured both parties, and one homeowner, a management company employee present during a settlement hearing did not have authority to bind the homeowners association.
