Calif. Jury Finds For Shea Homes on Negligence, Breach of Warranty

LOS ANGELES -- A California Superior Court jury rejected negligence and warranty claims brought by a Los Angeles family against one of the nation's largest homebuilders, finding that the family's health problems were not linked to any wrongdoing by the company. Achin v. Shea Homes, No. PC030022X (Calif. Super. Ct., Los Angeles Cty.).
Shea Homes was the only remaining defendant at trial. Superior Court Judge John Farrell granted defendant's pre-trial motions to dismiss a punitive damage claim and to limit injury claims to those for allergy-related illnesses. The verdict in the three-week trial was reached on Aug. 31.
