5th Circuit Finds Mold Claims Filed Too Late in Texas Case

NEW ORLEANS - The 5th Circuit Court of Appeals affirmed Nov. 28 in an unpublished opinion that homeowners' breach of contract and bad faith claims against State Farm Lloyds were filed too late. Trevino, et al. v. State Farm Lloyds, et al., No. 06-40427 (5th Cir.).
The three-judge panel also concluded that the U.S. District court for the Southern District of Texas properly dismissed claims against State Farm Lloyds Inc, based on its status as the agent for its affiliate.
