Wis. Couple Loses Bid to Sue Construction Firm's Individual Owners




WAUSAU, Wis. - The owners of a construction company blamed for water damage and mold in a rebuilt home may have engaged in puffery in soliciting the job, but their statements did not rise to the level of tortious misrepresentation, a Wisconsin appellate court affirmed on Nov. 29. Hansen v. Bartelt-Filo Inc., et al., No. 2006AP287 (Wis. Ct. App., Dist. II).

Wisconsin's Court of Appeals, District II, also said in its unpublished opinion that any statements Richard G. Bartelt and Richard L. Filo made about future enjoyment of the home amount to 'unfulfilled promises.'
