TROY, Mich. - Michigan's Court of Appeals on Nov. 14 affirmed dismissal of a homeowner's claims against two contractors hired to remediate water damage on Nov. 14, finding that neither contractor owed a duty to the homeowner or promised to follow any specific industry guidelines. Forester v. Servpro of Bloomfield & Livonia, et al., No. 268545 (Mich. Ct. App.).
Citing Fultz v. Union-Commerce Assocs, 470 Mich. 460, 463; 683 NW2d 587 [2004]), the court explained that under Michigan law '[t]here can be no tort liability unless the defendant owed [a] duty to the plaintiff.'
