FRESNO, Calif. - A California appellate court has affirmed a worker's compensation ruling for an employer that denied an employee's claim that workplace exposure to aspergillus mold spores exacerbated his asthma. Jordan v. Workers' Compensation Appeals Board, No. F051153 (Calif. Ct. App., 5th Dist.).
The 5th Appellate District said in an unpublished opinion on Nov. 21 that the Workers' Compensation Appeals Board was acting within its discretion when it rejected opinions by the treating physician and relied on the opinions of two other experts in finding for the employer.
