N.Y. Court Denies Motion for Summary Judgment on Remediation Demand

RIVERHEAD, N.Y. - A New York trial court has denied partial summary judgment to an apartment tenant who sought to compel her landlords to conduct additional mold remediation at her Westhampton, N.Y., apartment. Bittman v. The Sandcastle at Westhampton Beach Inc., No. 20308/2005 (N.Y. Sup. Ct., Suffolk Cty.).

The Suffolk County (N.Y.) Supreme Court cited evidence submitted by both sides that would need to be resolved at trial.

Betsy J. Bittman sued The Sandcastle at Westhampton Beach Inc. and several individuals complaining that her apartment has been uninhabitable since July 7, 2004, because of mold contamination resulting from water damage.
