JACKSON, Miss. - A federal judge declined to apply Mississippi's discovery rule to extend the filing period for personal injury claims where there was evidence that plaintiffs complained of mold and mildew in their mobile home more than three years before filing suit. Touchstone v. Starr Manufactured Homes, et al., No. 1:04CV886 (S.D. Miss.).
In a five-page opinion on Aug. 3, the judge also found plaintiffs' breach-of-contract and warranty claims untimely despite a six-year statute of limitations on those claims, saying they accrued at the time Linda and Realious Touchstone purchased the mobile home.
