Md. High Court to Consider Whether Physician Needed Frye Hearing

ANNAPOLIS, Md. - Maryland's Court of Appeals said Dec. 14 that it will hear arguments on the issue of whether a lower court should have held a hearing on admissibility before allowing testimony by a well known mold expert, who was plaintiffs' treating physician. Montgomery Mutual v. Chesson, et al., No. 110 Sept. Term 2006 (Md. Ct. App.).
The state's high court granted a petition for writ of certiorari submitted by Montgomery Mutual Insurance Co., which opposed worker's compensation benefits for six church employees who claimed exposure to mold in a wall cavity at their workplace.
