TOLEDO, Ohio - An Ohio appellate court affirmed summary judgment for landlord defendants on Dec. 29, finding that evidence that a defendant was cited for health violations wasn't enough to raise causation issues. Bogner v. Titleist Club LLC, et al., No. WD-06-039 (Ohio Ct. App., 6th App. Dist.).
The 6th Appellate District ruled that summary judgment on a negligence claim was appropriate given the tenants' failure to produce some medical evidence linking their symptoms to mold.
