Condominium Owner Fails to Persuade Court to Reinstate Claims

SAN JOAQUIN, Calif. - A California appellate court has affirmed dismissal of all claims brought by a condominium owner who complained that the building's managers failed to maintain common areas and prevent the spread of mold into his home. Bent v. Rivergate Commons, et al., No. C049917 (Calif. Ct. App., 3rd Dist.).

In an unpublished opinion issued on Dec. 5, the Court of Appeal, 3rd District, also declined to address plalintiff Edward Bent's appeal of attorneys' fees, leaving in place the trial court's award of $26,614.60 in fees for the condominium association and management company.
