TROY, Mich. - Michigan's Court of Appeals on June 27 affirmed judgment for a water park owner sued by a patron who blamed her fungal infection on exposure to spores linked to goose feces in the park. Henderson v. Volpe-Vito Inc., No. 266515 (Mich. Ct. App.).

The appellate court held in its unpublished opinion that the park visitor could not show through circumstantial evidence that the owner had 'implied knowledge' of fungus spores that caused the visitor's illness.
