Court Rejects Insurer's Challenge to 'Inconsistent' $90,000 Verdict

MONTGOMERY, Ala. - A federal judge has rejected an insurance carrier's post-trial challenge to a $90,000 verdict by jurors who rejected a negligence claim but found a roofing contractor liable for breach of contract. The Federal Insurance Co. v. Dean Construction Co., No. 2:04cv905-WHA (M.D. Ala.).
The verdict came on April 27, when a jury from the U.S. District Court for the Middle District of Alabama awarded $90,000 in damages to The Federal Insurance Co., the insurer for a bank building damaged by water and mold.
