BATAVIA, Ohio - Tenants who say they were forced out of their apartment because of mold-related health issues waited too long to sue their landlord, an Ohio appellate court affirmed on April 10. Craver v. Doogan, No. CA2005-06-055 (Ohio Ct. App., 12th Dist.).
Ohio's 12th District Court of Appeal also rejected the tenants' argument that a savings statute applied to preserve their personal injury claims from an earlier lawsuit.
Catherine R. and Jerome Craver appealed summary judgment awarded to former landlord Daniel J. Doogan by the Clermont County Court of Common Pleas.
