La. Court Reinstates Breach of Agency Claims against Agent and Broker

LAFAYETTE, La. - A Louisiana appellate court reinstated a homebuyer's claims against a real estate agent and broker on May 3, saying the parties' dispute over pre-sale disclosures should be resolved by a fact-finder. Baker v. Delhomme, et al., No. 05-1405 (La. Ct. App., 3rd Cir.).
Dr. Tim Y. Baker sued seller Francis Delhomme, agent Dennis Brooks and Stirling Properties Inc. for redhibition, breach of agency and damages, complaining that he was unaware of the extent of or seriousness of cracking in the exterior siding of his house until after its purchase.
