Court Finds that Private Sale Doesn't Give Rise to Unfair Trade Claim

HARTFORD, Conn. - A Connecticut trial judge on April 11 sided with courts holding that a one-time seller of residential real estate cannot be sued under the Connecticut Unfair Trade Practices Act. Belanger v. Maffucci, No. CV054013892S (Conn. Super. Ct., Hartford).
In striking one count brought against the seller of a single family home, Superior Court Judge Christine E. Keller noted that the issue has not been definitively resolved by Connecticut's appellate courts, but said 'this court agrees with the majority of superior court judges who have held that such actions do not fall under CUTPA.'
