Conn. Court Affirms Bar on Distress Claims From Property Loss

NEW LONDON, Conn. - A Connecticut court has dismissed an emotional distress claim from a mold case, saying the state doesn't recognize such claims when they arise solely from property damage. Kelly v. Rope Ferry Commons, et al., No. 5000095 (Conn. Super. Ct.).
Nancy Kelly sued Rope Ferry Commons, the owner of her condominium complex, and Myers Northwest, a management firm, after her unit was flooded by a water main break in a neighboring condominium.
Kelly charged that defendants were negligent in replacing her floor, resulting in mold contamination.
She asked for damages for property loss and also …
