Mich. Appellate Court Affirms $55,000 Verdict for Homeowners

TROY, Mich. - Michigan's Court of Appeals has rejected State Farm's appeal of a $55,000 mold verdict that resulted in a judgment against State Farm for half of that amount. Conant v. State Farm Fire & Casualty Co., No. 260524 (Mich. Ct. App.).

State Farm was apportioned 20 percent of the loss sustained by Gary and Bonnie Atkins-Conant, but was also responsible for a contractor's 30 percent of liability because of the jury's finding that the contractor was acting as State Farm's agent. The Conants were assessed 50 percent of the blame for any personal injuries or property damages.
