NEW ALBANY, Ind. - An Indiana federal judge ruled on June 2 that a mold exclusion applied to any and all mold claims, rejecting a homeowner's contention that the mold was an ensuing loss caused by poor workmanship of a plumber hired by the insurance company. Sammons v. State Farm Fire and Casualty Co., No. 4:05-cv-0028-JDT-WGH (S.D. Ind.).
Judge John D. Tinder of the U.S. District Court for the Southern District of Indiana said while there was still a dispute over who hired the workman, that issue needn't be resolved as the policy exclusion was clear.
