TROY, Mich. - Michigan's Court of Appeals on May 9 affirmed a trial court finding that water and mold damage at a business was not covered under a businessowner's policy that excluded water damage, even if caused by an accidental municipal water main break. Commerce Center Partnership v. Cincinnati Insurance Co., No. 265147 (Mich. Ct. App.).

The appellate court held that a water exclusion clearly applied, and rejected Commerce Center Partnership's contention that coverage was warranted if even one of the two causal factors - water or mold - was present.
