TROY - Michigan's Court of Appeals on March 28 ordered summary judgment for a building contractor's insurer after concluding that mold contamination of a subfloor and framing in a single-family home was not an 'occurrence' triggering insurance coverage. Hastings Mutual Insurance Co. v. Mosher, Dolan, Cataldo & Kelly Inc., No. 26521 (Mich. Ct. App.).
In an unpublished, per curiam opinion, the court reversed a trial court order granting judgment to Mosher, Dolan, Cataldo & Kelly Inc., which an arbitrator found liable for mold and other defects on claims by homeowners Lisa and David Feinbloom.
