Court Reinstates Lawsuit Over Pella's Aluminum-Clad Windows

CHICAGO - The Appellate Court of Illinois has reinstated a lawsuit alleging that Pella Corporation failed to alert consumers that the company's windows could leak, leading to rot and deterioration. Pappas v. Pella Corp., No. 1-05-1702 (Ill. Ct. App., 1st Dist.).

In an opinion released on Feb. 21, the Appellate Court's First District, Second Division, reversed the Cook County Circuit Court's dismissal of claims by Sam and Mary Pappas alleging that Pella violated the Illinois Consumer Fraud and Deceptive Business Practices Act (815 ILCS 505/1 et seq. [West 2000]).
