Court Says Wall Covering Seller Not Liable Under La. Product Liablity Act

BATON ROUGE, La. -A company that sold vinyl wallcovering used in a casino that later experienced mold contamination could be sued in tort but is not subject to liability as a manufacturer under Louisiana's Product Liability Act, a federal judge ruled on Feb. 2. Tunica-Biloxi Indians of Louisiana v. Pecot, et al., No. 02-1512 (W.D. La.).

The ruling by Senior Judge F.A. Little Jr. of the U.S. District Court for the Western District of Louisiana addressed only the issue of DesignTex Group Inc.'s liablity under the LPLA.
