WEST PALM BEACH, Fla. - A Florida appellate court ruled on Feb. 22 that a home insurer may have to pay for additional repairs to a mold-contaminated home even though the carrier has already paid out the policy limits. Drew v. Mobile USA Insurance Co., No. 4D04-4761 (Fla. Ct. App., 4th Dist.).
Florida's Fourth District Court of Appeal said in reversing summary judgment for the insurer that the homeowners have raised a genuine issue as to whether Mobile USA Insurance Co. exercised its option to repair, thereby creating a new contract between the carrier and the homeowners.
