Court Affirms Rulings Limiting Testimony by Calif. Plaintiffs' Experts

SANTA BARBARA, Calif. - A California appellate court affirmed judgment for landlord and employer defendants after concluding that a trial court did not abuse its discretion in excluding mold sampling data and plaintiffs' expert testimony that relied on the data. Geffcken v. D'Andrea, No. B176232 (Calif. 2nd App. Dist.).

Eva and Alexander M. Geffcken sued Samuel D'Andrea and other parties, alleging injury from mold exposure at an apartment in the El Escorial Villas in Santa Barbara, Calif. In the same complaint, Eva Geffcken also alleged exposure while employed as a caregiver in the Casa Dorinda retirement complex in Montecito, Calif.
