Nevada High Court Rewrites Alternatives to Supersedeas Bond

CARSON CITY, Nev. - Agreeing that the 'unusual circumstances' requirement was outdated, the Nevada Supreme Court on Dec. 6 used a mold contamination case to ease the alternative security criteria for defendants who may have difficulty obtaining supersedeas bonds to guarantee judgments that are on appeal. Nelson v. Heer, No. 45571 (Nev. Sup. Ct.).
The Supreme Court denied the motion for stay by appellant Judy Nelson, however, saying the trial court, which rejected Nelson's initial offer of alternative security, should first have an opportunity to weigh Nelson's newer proposals.
