ATLANTA - Georgia's Court of Appeals ruled Nov. 9 that dismissal of a mold personal injury case was an appropriate sanction for plaintiffs' repeated failure to file timely responses to defendants' discovery request. Gropper, et al. v. STO Corp., et al., No. A05A1012 (Ga. Ct. App.).
Gary and Vickie Gropper sued Renaissance Building Corp. and other parties in Fulton County (Ga.) Superior Court, alleging that defendants' use of STO Corp.'s exterior siding in the construction of their home was unauthorized, and that construction defects led to water intrusion and mold contamination.
