Court Finds for Inspector But Declines to Extend Immunity to County

RALEIGH, N.C. - North Carolina's Court of Appeals affirmed Nov. 1 that a county government cannot exercise its governmental immunity because it purchased insurance that could protect it against a homeowners' personal injury lawsuit. McCoy v. Coker, et al., No. 04 CVS 643 (N.C. Ct. App.).
The court did reverse the lower court's denial of summary judgment for the county building inspector, however, finding that the inspector was acting within the scope of his employment when the acts complained of occurred.
