SOUTH BEND, Indiana - A federal court has granted in part defendant Monaco Coach Corporation's motion for summary judgment in a case alleging defects and mold contamination in a motor home. Pizel v. Monaco Coach Corp., No. 3:04-CV-286 CAN (N. D. Ind.).
In an Aug. 3 decision, the Northern District of Indiana denied Monaco's motion for summary judgment for failure to prove damages, but the court granted the motion as it related to plaintiff Robert Pizel's mold claims.
Pizel purchased a 2004 Holiday Rambler Endeavor motor home with a limited written warranty covering defects in materials and manufacture.
