NASHVILLE - The Tennessee Court of Appeals on Sept. 20 affirmed a lower court order that Travelers Indemnity Co. defend a building contractor in an arbitration over allegations that design and construction defects led to water intrusion and mold damage in a Nashville hotel. The Travelers Indemnity Company of America v. Moore & Associates, No. M2004-01233-COA-R3-CV (Tenn. Ct. App.).
Travelers issued three one-year comprehensive general liability policies to Moore & Associates between 2000 and 2003, with each policy providing coverage of up to $1 million per occurrence or an aggregate of $10 million.
