N.Y. Court Orders Apartment Co-Op to Turn Over Engineering Report to Tenants

NEW YORK - A New York trial court has ordered the 420 East 72nd Street Tenants Corp. to provide tenants with a copy of an engineering report prepared in response to tenants' complaints of humidity and potential mold growth. In the Matter of the Petition of Gross, et al., No. 106573/05 (N.Y. Sup., N.Y. Cty.).

Mitchell Gross and Christine Debouck sought the pre-litigation discovery order, saying that the building managers had refused to provide a copy, apparently, Gross and Debouck said, because of the potential for litigation.
