N.Y. Judge Denies Condo Owners' Bid for Injunction Against Building Management

MINEOLA, N.Y. - A New York trial court judge on Aug. 10 denied condominium owners' request for injunctive relief, including a $50,000 escrow fund for alternative living costs. Epstein, et al. v. Ocean Court Condominium Association, et al., No. 018917/03 (N.Y. Sup. Ct., Nassau Cty.).

Nassau County (N.Y.). Supreme Court Justice Daniel Martin said that plaintiffs David B. Epstein and Marzena Epstein failed to demonstrate irreparable injury if the injunction was not granted and will be adequately compensated by the money damages they seek.

The Epsteins own and reside at an Ocean Court Condominium Association unit in Long Beach, N.Y.
