NEW YORK - A New York court has declined to accept a tenant's contention that she was forced to completely abandon her cooperative apartment because of mold issues and ordered her to place nearly $41,000 in unpaid maintenance payments in escrow. Kelly v. Orsid Realty Corp., et al., No. 104933/03 (N.Y. Sup., N.Y. Cty.).
