NEW YORK - A New York trial court has ordered a personal injury case to trial after finding that factual issues of notice and causation preclude summary judgment. Daitch v. Naman, No. 0126968/2002 (N.Y. Sup., N.Y. Cty.).
Lawrence Daitch contends that a negligent renovation project in his building caused hazardous particles and mold to contaminate his apartment and had an adverse effect on his health.
