AUSTIN, Texas - A Texas appellate court has reversed summary judgment granted a condominium association, finding that a real estate inspector sufficiently raised the issue of whether the association breached a duty to tenants. Willis v. Bay North Homeowners Association Inc., No. 03-04-00453-CV (Texas App., 3rd Dist.).
The Aug. 3 opinion by the Texas Court of Appeals, 3rd District, came in an appeal by Charles E. Willis, the defendant in a lawsuit brought by former clients Jim and Sandra Breashears.
