WAUSAU, Wis. - A Wisconsin appellate panel has affirmed judgment for a school district on claims that the school's delay in addressing mold issues endangered student plaintiffs' health. Nejedlo, et al. v. School District of Wausaukee, et al., No. 2004AP2465 (Wis. App., Dist. III).
In a June 1 per curiam opinion, the Wisconsin Court of Appeals, District III, held that Wisconsin statutes and administrative codes dealing with school health and safety issues do not impose a ministerial duty on school districts sufficient to allow an exception to Wisconsin's governmental immunity law (Wis. Stat. § 893.80[4]).
