Purchase of a New Home 'As Is' Bars Washington Couple's Lawsuit Against Builder

SEATTLE, Wash. - A Washington couple's agreement to have their new home inspected before purchasing it 'as is' prevents them from later bringing a claim for faulty workmanship, a Washington State appellate court affirmed May 10. Warner v. Design and Build Homes Inc., et al., No. 30722-7-II (Wash. Ct. App., Div. II).

The court also affirmed in its unpublished opinion that Curtis & Ana Warner were not party to the contract between the builder, Design and Build Homes Inc., and Omega Pacific Lath & Plaster Inc., a subcontractor, and cannot maintain an action against the subcontractor.
