Minn. Appellate Court Reinstates Lawsuit Against Builder, Subcontractors

ST. PAUL, Minn. - Minnesota's Court of Appeals held April 12 that the state's 10-year statute of repose, when applied with the applicable two-year statute of limitations, allows a contribution claim that accrues in the 11th or 12th year after a home's construction. Weston v. McWilliams & Associates Inc., No. A04-1251 (Minn. App.).

The issue was whether a contractor sued by homeowners two months before the 10th anniversary of completion of their home could bring contribution claims against subcontractors after the 10-year period, but within the additional two-year statute of limitations.
