Texas Court Reverses Judgment for Lawyer in Dispute Over Insurance Proceeds

HOUSTON -- A Texas appellate court on April 5 reversed a trial court decision giving rights to an insurance check to a homeowner's lawyer, remanding the dispute for further review. Miller v. Schwartz, No. 14-04-0032-CV. (Texas App. 14th Dist.).

Plaintiff Stanley G. Miller (d/b/a Mold Eliminators) appealed a trial court order granting summary judgment to attorney Newton B. Schwartz Sr. in a dispute over an insurance check made out to Miller, Schwartz and homeowner Paula Harris. Harris and her insurance company are no longer parties to this suit.
