N.Y. Court Denies Summary Judgment, Says Causation Issues Must Be Tried

NEW YORK - A New York trial court rejected summary judgment motions by a tenant and his landlord recently, saying that the factual causation issues can only be resolved at trial. Krasnow v. JRBG Management Corp., No. 107416/02 (N.Y. Sup., N.Y. Cty.).

New York County Supreme Court Justice Marylin G. Diamond on April 12 denied a motion and cross-motion by plaintiff Marc Krasnow and his former landlord, JRBG Management Corp.

Krasnow alleges personal injury and damage to his property from mold that contaminated his rented apartment because of rainwater infiltration and inadequate attempts at repair by JRBG. Krasnow wants …
