MCALLEN, Texas - A Texas couple contend in their answer to a recently filed declaratory judgment action that Gulf Underwriters is wrong in asserting that the underlying action against a mold remediator was undefended and ask that the case be dismissed. Gulf Underwriters Insurance Co. v. Gordian Environmental LLC, et al., No. M-04-402 (S.D. Texas).
Gulf Underwriters filed the coverage suit on Nov. 18 against Richard and Ivonne Cano of McAllen, Texas,, plaintiff homeowners in the underlying suit, and against Gordian Environmental of Pharr, Texas. The Canos sued Gordian in Hidalgo County, Texas, alleging that Gordian failed to complete a …
