U.S. Supreme Court To Consider Jurisdictional Dispute in Va. Mold Case




WASHINGTON, D.C. - The U.S. Supreme Court decided Feb. 28 to hear argument from parties to a Virginia mold action who dispute federal court jurisdiction. Lincoln Property Co., et al. v. Christopher Roche, et ux., No. 04-712 (U.S. Sup.).

Lincoln Property Co. is appealing the 4th Circuit Court of Appeals' opinion vacating summary judgment for Lincoln. The 4th Circuit found that the participation of in-state partners in the property-management company defeated diversity jurisdiction [See July 2004 Issue].
