NEW YORK - A New York trial court recently ordered an apartment tenant to allow access to the landlord's chosen mold remediator. March v. Melohn Properties, No. 101773/04 (N.Y. Sup., N.Y. Cty.).
Carole F. March filed the complaint after the New York City Department of Housing Preservation & Development filed a violation notice over mold on her bathroom ceiling. She sought an injunction ordering Melohn Properties and Orsid Realty Co. to remediate the mold 'pursuant to guidelines set forth by the New York City Department of Health and Mental Hygiene Bureau of Environmental and Occupational Disease Epidemiology.'
