Wash. Appellate Court Affirms Summary Judgment For Homebuilders




SEATTLE, Wash. - A Washington homeowner knew in 1999 that she had a potential cause of action against her home's builders but waited too long to sue, a state appellate court affirmed Nov. 22. Yeater v. Commonwealth Insurance Co., No. 53628-1-I (Wash. App., Div. 1).

In an unpublished opinion, the Washington Court of Appeals, Division One, cited written documents from plaintiff Sandra Yeater that would leave a jury no choice but to find that Yeater failed to sue her builder's insurer and other parties until well beyond the three-year limitations period.
